Medical Liability
The court system of the United States faces many problems. There is a logjam in the system, as many people have initiated lawsuits. The logjam is a result of frivolous lawsuits that people bring to court. One area of such lawsuits is in the medical field. Many doctors get sued by patients. As a result, many doctors, afraid of being sued, cannot practice medicine in the fullest way possible.
President Bush has tried to take action to curb burdensome lawsuits and bring about medical liability reform. He has tried to get Congress to pass laws that help with his goals. Among the guidelines he has supported are:
- Not letting recovery for non-economic damages exceed $250,000
- Allowing injured patients to get effective, quick, unlimited compensation for economic losses suffered
- Allowing payments to be paid over time rather than only at once in a lump sum
- Setting a time limit for cases to be brought to court
- Limiting damages within reasonable amounts
- Ensuring that defendants pay judgments that are proportionate to the fault that they are at
The ramifications of unnecessary lawsuits in the United States are severe. As mentioned above, doctors are afraid to practice medicine, and the courts system cannot keep up with all of the cases. Such cases sap resources from where they are needed and expend them on unproductive uses.
